If the offence is non cognizable and hence, if police have registered it in N. C. Register, then the police dept. is not empowered to investigate the matter without permission of magistrate. Therefore, if the aggrieved party goes to the court or if magistrate permits the police to investigate the complaint, then only police have any role. Otherwise N. C. cases remains close automatically. As far as the F. I. R. of cognizable offence is concerned, it remains open till the investigation is complete and charge sheet or negative report is sent by police to the court. The court may accept or reject the report of the police. The magistrate himself can take cognizance of the case or can send the matter to the police for reinvestigation. If the accused is absconding the matter remains on investigation permanently. If the offence is serious and punishable with imprisonment more than 3 years, there is no limitation period, and the file remains open till the accused is/are alive. If the offence is cognizable but punishable with imprisonment less than 3 years, and if the accused is not absconding, the matter is closed after limitation period is over....
