Are tasers & stun guns legal in maryland?

I am looking to buy a taser or stun gun in Maryland. I have found several websites that state their legality depends on the specific area of Maryland you reside in. However, I previously consulted a Maryland prosecutor about tasers, and he indicated that they are outright illegal in the state. I suspect he may have been trying to discourage me from pursuing this, rather than providing accurate information. I would appreciate the opinion of a lawyer or a link to an official Maryland government website regarding taser laws. Additionally, if there have been any relevant judicial rulings concerning the use of tasers in Maryland, that information would be very helpful. Thank you.

They are legal under state law, but there are restrictions. Maryland’s law on tasers is relatively new (and was passed after a COP killed a guy accidentally with one, go figure) and is under the Criminal Code §4–109.

Basically, to have one, you have to be at least 18 years old and cannot have prior convictions for a violent crime or a drug crime.

The same law also sets restrictions on who can sell them to you. The seller is required by law to provide an instruction manual or video, has to keep a record of your personal information when you buy it that you are the owner, and has to perform a criminal background check on you before they can sell it. While this law applies to the seller and not you the buyer per se, it does make it more difficult to buy them. Most stores do not have the capability to run background checks except gun shops (and I don’t know if gun shops do it for Tasers). This means you usually have to buy them directly from Taser International. This sales restriction also means that stun guns (the cheap ones you have to touch to your attacker) basically cannot be sold in the state because they don’t have records systems at their manufacturers.

Several counties within Maryland have ordinances against possessing or carrying them, however, so you also have to check your county code. Anne Arundel is one I believe.

TASERs are one of the best options to control another person but if your budget does not allow then a stun gun is a great option.

They can be carried in Maryland no problems at all. Stun-Guns and Tasers are prohibited for citizen use in the District of Columbia, Hawaii, Massachusetts, New York, New Jersey and Rhode Island and their use in Connecticut, Illinois, and Wisconsin is only legal with certain restrictions.

The Patriot Self Defense program is just a very straightforward and to follow. You don’t need to be a genius or some sort of martial arts specialist because this program is good for the average guy.
